Judge Mustafa Kasubhai, appointed in 2023, delivered a ruling that challenged a declaration made by Health and Human Services Secretary Robert F. Kennedy Jr. regarding the safety and efficacy of certain medical interventions.

Kennedy Jr.’s December declaration asserted that “sex-rejecting procedures” – encompassing puberty blockers, cross-sex hormones, and surgeries – were “neither safe nor effective” for children. The judge found this declaration to be an overreach of authority, criticizing the failure to adhere to established administrative procedures when issuing such a significant statement.

This ruling offers immediate relief to healthcare professionals providing these treatments, preventing the federal government from enforcing the declaration against hospitals and medical providers. The case originated from a coalition of twenty states and Washington D.C., all of which had already legalized these controversial medical services.

The core of the dispute lies in the process, or lack thereof, used to formulate the declaration. Kennedy Jr. based his assessment on a “comprehensive evidence review” citing documented risks and a lack of conclusive benefits. However, the judge determined that the manner in which this conclusion was reached bypassed necessary legal protocols.

The original declaration specifically defined “sex-rejecting procedures” to include a range of pharmaceutical and surgical interventions aimed at aligning physical appearance with an asserted gender identity different from the individual’s sex at birth. This definition encompassed procedures like mastectomies and vaginoplasties, alongside hormone therapies.

Opponents of the declaration argued it was an unlawful attempt to override established medical standards without the required public input and comment period. The government countered that the statement was a non-binding policy position, exempt from typical rule-making requirements.

Judge Kasubhai, during a six-hour hearing, expressed concern over a perceived pattern of “break it and see what others will do” governance. He emphasized the importance of upholding the rule of law and respecting the democratic principles that demand transparency and adherence to established procedures.

New York Attorney General Letitia James, leading the legal challenge, hailed the ruling as a victory for patients, families, and healthcare providers. She underscored the real-world harm caused by what she described as federal government “attacks” on transgender healthcare, citing lost access to vital treatment and intimidation of medical professionals.

James emphasized that the ruling reaffirms the legality of transgender healthcare services and protects providers from federal interference. She pledged continued advocacy for the LGBTQ+ community, framing the fight as a defense of fundamental rights and access to necessary medical care.

The lawsuit drew support from a broad coalition of states, including California, Illinois, Massachusetts, and Pennsylvania, reflecting a deep divide over the appropriate approach to gender-affirming care for minors. The case unfolded against a backdrop of increasing political scrutiny of these treatments.

Adding another layer to the debate, former President Donald Trump has publicly vowed to “protect children from transgender mutilation surgeries” and is attempting to incorporate this pledge into a proposed election-integrity bill currently under consideration in the Senate. This move underscores the escalating politicization of this sensitive medical issue.
