This isn’t a matter of reasonable doubt; it’s a matter of rights being violated during the investigation itself.

Researchers meticulously examined 627 Ontario court rulings spanning from 2015 to mid-2025, uncovering a staggering total of over 1,000 documented Charter breaches. The sheer volume of violations paints a troubling picture of systemic issues within law enforcement practices.

In a significant 70% of these cases, the repercussions were severe: evidence was deemed inadmissible, legal proceedings were halted entirely, or sentences were reduced. This erosion of the judicial process, researchers warn, directly undermines public trust and inflicts further harm on victims seeking justice.

What specific rights are being trampled? The most frequent violations center around unlawful searches and seizures – officers overstepping their authority – and the denial of timely access to legal counsel. These aren’t minor oversights; they are fundamental rights guaranteed to every individual within Canada’s legal framework.

It’s important to note this report focuses solely on cases that reached the courtroom. It doesn’t account for instances where charges were never laid or were withdrawn before trial, suggesting the actual number of Charter breaches could be even higher. The true scale of the problem may be far greater than currently understood.

The report’s findings are a call to action. Experts are demanding increased oversight, accountability, and transparency from police forces, as well as independent review bodies and government agencies. The current system, they argue, is failing to adequately address these critical issues.

The stakes are incredibly high. Valuable evidence – including evidence related to serious crimes like gun possession, drug trafficking, child pornography, and impaired driving – is being systematically excluded from trials. This jeopardizes public safety and allows potentially dangerous individuals to avoid facing the full consequences of their actions.
