Democrats in the state have introduced a bill that would effectively bar police forces from hiring agents brought on by Immigration and Customs Enforcement (ICE) during the final years of the previous presidential administration.

This move represents a significant escalation in the state’s resistance to federal immigration policies, fueled by growing concerns over tactics employed during a period of heightened deportation efforts. Lawmakers and governors critical of those policies argue they were a response to perceived changes in border enforcement, and that the methods used were overly aggressive.

Dubbed the “ICE OUT Act,” the proposed legislation would amend existing law enforcement accountability measures to specifically prohibit the hiring of any individual who became a sworn ICE officer on or after January 20, 2025. The restriction is designed to address concerns about hiring standards and build trust between law enforcement and the communities they serve.

The policy, if enacted, would not impact officers already serving in Rhode Island police departments who previously worked for ICE. It is slated to take effect in October 2026, providing a window for implementation and potential adjustments.

Supporters of the bill contend that the hiring practices of the Department of Homeland Security during the previous administration did not meet the standards expected in Rhode Island. They believe stricter vetting and a focus on community policing are essential for maintaining public trust.

However, the proposal has sparked concern among some police officials, who warn that it could exacerbate existing recruitment challenges. They fear limiting the pool of potential candidates will further strain already stretched resources.

Beyond the hiring restrictions, another bill under consideration would create a 200-foot buffer zone around polling places, prohibiting ICE agents from being present in those areas. Proponents argue this is necessary to prevent intimidation and ensure free and fair elections, particularly within immigrant communities.

The state capital, Providence, has already taken steps to limit the presence of federal immigration enforcement officials. A recent executive order from the mayor designates parking lots, schools, parks, and government buildings as restricted areas for DHS officers.

The mayor’s order emphasizes the city’s responsibility to maintain public trust and ensure equal access to essential services for all residents, regardless of immigration status. This action underscores a commitment to creating a welcoming environment and protecting vulnerable populations.

The unfolding debate highlights a deepening divide over immigration enforcement strategies and the role of federal agencies within state and local communities. The outcome of these legislative efforts could have far-reaching consequences for both law enforcement and immigrant populations in Rhode Island.
