A major Silicon Valley technology company now faces a federal lawsuit alleging deliberate discrimination against American workers. The Department of Justice accused Cloudera Inc. of systematically favoring foreign visa holders for lucrative tech positions, effectively shutting out qualified U.S. citizens.

The core of the accusation centers around a deliberately constructed, separate hiring process. This process wasn’t designed to find the best candidates – it was designed to discourage and exclude American applicants while expediting the hiring of individuals on temporary visas, according to the lawsuit.

Officials stated that employers cannot exploit the legal PERM sponsorship process to mask discriminatory practices. The Justice Department vowed to aggressively pursue companies intentionally creating barriers for American workers seeking employment opportunities within their own country.

The alleged scheme involved a dedicated email address for job applications, a seemingly standard practice. However, this email was intentionally configured to reject any submissions originating from outside the company, creating an immediate obstacle for American applicants.

American workers diligently followed the company’s published application instructions, only to receive automatic “bounce-back” messages. These messages effectively blocked their applications from even being considered, a clear indication of a hidden agenda.

The Justice Department’s investigation revealed that Cloudera not only created this exclusionary email system but also failed to genuinely recruit U.S. workers when sponsoring employees for permanent residency through the PERM program. This program legally mandates a good-faith effort to hire American talent first.

While actively seeking permanent residency sponsorships for foreign workers, Cloudera allegedly bypassed the required good-faith recruitment of American citizens. This created a system where U.S. applicants were effectively sidelined in favor of those with temporary work visas.

Federal law is unequivocal: companies seeking to sponsor foreign workers for permanent residency cannot discriminate against American citizens. Employers are legally required to attest, under penalty of perjury, that job openings are free from unlawful discrimination based on citizenship, among other factors.

The Department of Justice is seeking a comprehensive court order to halt these alleged illegal hiring practices. This includes financial penalties for each affected American worker, compensation for lost wages, and any further corrective actions deemed appropriate by the court.

This lawsuit is part of a broader initiative focused on protecting U.S. workers from companies that prioritize temporary visa holders over American citizens. Prior to this case, the initiative had already secured ten settlements against companies engaging in similar practices.

Interestingly, Cloudera previously joined a coalition of major tech companies in opposing a temporary travel ban enacted several years ago. The company argued the policy hindered their ability to recruit foreign talent, a position that now appears strikingly ironic given the allegations against them.

The lawsuit suggests a calculated strategy: while publicly advocating for broader access to foreign visa programs, Cloudera was simultaneously manipulating its own hiring system to favor those programs, effectively disadvantaging American workers in the process.
