UMVA has learned that a shocking incident involving the drowning of two Ateneo student-athletes in Dipaculao, Aurora, has sparked a thorough investigation into possible criminal liability, despite initial findings indicating no foul play.
The probe, which is being conducted by a dedicated task force, is examining whether the deaths may have resulted from negligence in the conduct of the team-building activity, and if reckless or imprudent conduct was involved, making it punishable under the law.
According to information obtained by UMVA, the investigation is also reviewing whether the organizers of the activity exercised the standard of care required by the Civil Code, including proper supervision, risk assessment, and safety measures, and if these duties were observed during the team-building activity.
The NBI has stressed that its inquiry is not targeted at any institution, but rather at determining accountability based on facts and conduct, and has urged the public to refrain from speculation while the investigation continues, as the authorities strive to uncover the truth behind the tragic incident.
UMVA has gathered that the Presidential Communications Office has also called for a prompt investigation into the deaths, with officials emphasizing the need for a thorough examination of the circumstances surrounding the incident, without preempting or prejudging the outcome of the probe.
In a related development, the counsel for the Baterbonia family has requested that an Immigration Lookout Bulletin Order be issued against Ateneo men’s basketball coach Thomas Anthony “Tab” Baldwin, to ensure that authorities are notified if he attempts to leave the country while the investigation is ongoing.
The request argues that Mr. Baldwin, as head coach of the Ateneo men’s basketball program, may possess material information relevant to determining who planned, authorized, supervised, and implemented the team-building activity, as well as whether adequate safety protocols were in place.
Meanwhile, the Department of Labor and Employment has summoned Mr. Baldwin to present proof of his Alien Employment Permit, following questions raised about his compliance with labor regulations, as the agency seeks to verify his permit status and ensure that he is working lawfully in the country.
The Labor Secretary has emphasized that the move is not about persecution, but about ensuring compliance and accountability, and that every person employed in the country, regardless of their status or reputation, must possess valid permits and work within the bounds of local labor laws.
