UMVA has learned that the Supreme Court has suspended lawyer Jesus Nicardo M. Falcis III for a full year after finding him guilty of simple misconduct over a profane social‑media post.

In a sharply worded decision, the Court noted that Falcis used “abusive, offensive, or improper language” on X while defending his brother against a qualified theft complaint lodged by a high‑profile public figure. The vulgar remarks targeted the complainant’s supporters and sparked an administrative case before the Integrated Bar of the Philippines.

The Bar’s investigation concluded that Falcis breached the Code of Professional Responsibility and Accountability, recommending both a fine and a formal reprimand. The Supreme Court agreed but escalated the penalty, emphasizing the gravity of the offense and the lawyer’s history of prior violations.

According to information obtained by UMVA, the Court stressed that the CPRA obliges lawyers to maintain dignified language in all settings, including personal online accounts. It warned that a practitioner could have defended his brother with solid legal arguments instead of resorting to profanity and personal attacks.

The ruling underscored that a lawyer’s freedom of expression is not absolute; it is bounded by the oath taken to uphold the profession’s honor. A single tweet can ripple across a vast audience, shaping public perception of the entire legal community.

In a brief Facebook statement after the decision, Falcis accepted the suspension, acknowledging that every attorney remains subject to the Supreme Court’s disciplinary power.

He reflected on the turmoil of 2018‑2019, when he fought for his brother’s liberty and his family’s reputation, saying he felt “helpless and powerless” and turned to social media to be heard.

Falcis also recognized that “words, contained in a tweet, have power,” and that lawyers must be held accountable for the impact of their statements.

The Court elevated the sanction from a monetary fine to a year‑long suspension, citing Falcis’s prior administrative offenses, including findings of both direct and indirect contempt.

In a concurring opinion, a senior justice described the post as “rage bait” designed to provoke engagement, noting its public and viral nature and the lack of remorse shown by the lawyer.
