A federal judge, appointed during the Biden administration, is once again at the center of a legal firestorm. Judge Brian Murphy recently issued a temporary block on policies enacted by the Trump administration regarding vaccines, a move that has ignited fierce criticism from conservatives and prompted a sharp response from the Department of Justice.

This isn’t an isolated incident. Judge Murphy’s rulings have repeatedly faced reversals on appeal, including twice being directly intervened upon by the Supreme Court in a separate deportation case. Deputy Attorney General Todd Blanche publicly questioned the frequency of these reversals, expressing frustration with what he characterized as “activist decisions.”

The latest dispute centers around a lawsuit brought by medical organizations against Health and Human Services Secretary Robert F. Kennedy Jr. Judge Murphy granted a preliminary injunction, asserting that Kennedy likely violated the law when revising the Centers for Disease Control and Prevention’s vaccine policies. This action effectively halts a planned immunization schedule for January 2026.

In his ruling, Judge Murphy invoked the words of Carl Sagan, stating that science is “the best we have,” and emphasized the proven benefits of vaccines. He stayed the new CDC schedule, which would have reduced vaccine requirements for children, and invalidated a newly appointed vaccine advisory committee.

Legal experts have pointed to a perceived inconsistency in Judge Murphy’s approach. Professor Ilan Wurman of the University of Minnesota Law School questioned why the court would defer to public health experts in some cases, but not in others, suggesting a potential double standard at play.

The controversy extends beyond the vaccine case. Earlier this week, the U.S. Court of Appeals for the 1st Circuit paused Murphy’s earlier decision to block the Department of Homeland Security’s third-country deportation policy. This policy, if allowed to stand, could have impacted the deportation of thousands of individuals.

Senator Jim Banks highlighted what he sees as a political bias, noting that judges appointed by Democrats have often supported expansive interpretations of gender identity in transgender policy cases, even when those interpretations appeared to contradict scientific consensus. He contrasted this with Murphy’s stance on the vaccine policies.

Last year, the Supreme Court issued two unusual orders regarding Judge Murphy’s rulings on the third-party deportation policy. The second order was particularly rare, directly admonishing the judge for seemingly disregarding the Court’s initial decision. Legal scholar Jonathan Turley described Murphy’s actions as giving “a stiff arm” to the highest court in the land.

The repeated interventions and reversals raise fundamental questions about the role of a trial judge and the balance of power within the judicial system. Critics argue that Judge Murphy’s decisions demonstrate a pattern of overreach, while supporters maintain he is simply upholding the law as he interprets it.
