A federal judge has, for a second time, firmly rejected the Justice Department’s attempt to compel testimony from the Federal Reserve regarding a criminal investigation into Chairman Jerome Powell. The case centers on a grand jury subpoena related to Powell’s past statements concerning extensive renovations at the Fed’s Washington D.C. headquarters.

The judge, James Boasberg, initially quashed the subpoenas last month, expressing strong concerns about their legitimacy. He suggested the requests were improperly motivated, potentially stemming from external pressure on Powell to lower interest rates. This latest ruling reaffirms that initial assessment, finding the government’s arguments unconvincing.

The investigation itself began in January when Powell disclosed the receipt of the subpoenas. They reportedly relate to his testimony before the Senate Banking Committee, specifically concerning the escalating costs of the Fed building’s renovation project. Despite the criminal inquiry, no charges have been filed against Powell.

The renovation project, initially approved in 2017 with a $1.9 billion budget, has seen its costs surge to $2.5 billion. The Federal Reserve attributes this increase to unforeseen complications encountered during construction, including unexpectedly high levels of asbestos, soil contamination, and a problematic water table.

The scrutiny of Powell intensified last July when a member of Congress formally requested the Justice Department pursue criminal charges, alleging perjury. This request followed concerns raised by lawmakers regarding the perceived extravagance of the renovations and questions about transparency in the project’s management.

The judge’s decision has sparked considerable controversy, with some legal figures openly criticizing the ruling. One prominent voice, a former US Attorney, described the judge’s actions as obstructing the legal process and preventing a grand jury from fulfilling its duty. She characterized the situation as a fundamental departure from the principles of justice.

Boasberg’s previous statements during the proceedings revealed his disapproval of both the former president and the US Attorney involved in pursuing the subpoenas. He indicated a belief that the investigation was not based on genuine evidence of wrongdoing, but rather on external influence and political motivations.

The core of the dispute remains the ballooning cost of the renovation. What began as a modernization project has become a focal point of political and legal contention, raising questions about oversight, accountability, and the potential for undue influence within the Federal Reserve.
