Gilbert’s investigation revealed that Swalwell and his wife employed Amanda Barbosa, a Brazilian national, as a live-in nanny under the J-1 visa program. While initially lawful, Barbosa’s work authorization expired at the end of 2022. Despite this expiration, evidence suggests she continued in the role for two additional years.

The Swalwells reportedly attempted to secure permanent work authorization for Barbosa, even submitting a formal job posting outlining demanding requirements. However, the Department of Labor ultimately denied their application. Instead of finding a legally authorized replacement, the evidence suggests Barbosa remained employed “off the books.”

Gilbert’s evidence includes social media activity showing Barbosa actively engaged with the Swalwell family throughout 2023 and 2024, her LinkedIn profile listing continuous employment, and financial records indicating continued childcare payments. These details raise serious questions about potential violations of immigration, visa, tax, and labor laws.

The allegations don’t stop at immigration concerns. Gilbert’s FEC complaint alleges a misuse of campaign funds, claiming over $300,000 was spent on childcare expenses over five years. This raises the specter of personal expenses being disguised as campaign-related costs.

Swalwell had even sought guidance from the FEC regarding the use of campaign funds for childcare, receiving a clear response that such expenses were permissible only when directly tied to specific campaign events and properly documented. The complaint alleges Swalwell disregarded this guidance, effectively subsidizing personal childcare through donor money.

The pattern, as outlined in the complaints, is striking: an initial attempt at compliance, followed by a disregard for legal limitations when faced with unfavorable rulings. This suggests a deliberate effort to circumvent the law for personal gain.
