The Justice Department, representing the previous administration, has formally requested a reconsideration of a judge’s order blocking subpoenas issued to Federal Reserve Chair Jerome Powell. This move signals an intent to escalate the legal battle, following a promise by the U.S. Attorney for D.C. to challenge the initial ruling.

Prosecutors contend the court employed an incorrect legal standard and overlooked crucial facts. They argue a subpoena is justified if there’s even a “reasonable possibility” the requested materials will yield information relevant to the grand jury’s investigation, even if the recipient suggests an ulterior motive.

The dispute stems from subpoenas issued to the Federal Reserve Board, which U.S. District Judge James Boasberg previously blocked. He concluded the subpoenas were a thinly veiled attempt to pressure Powell into lowering interest rates or resigning his position.

The Justice Department maintains the subpoenas sought materials directly related to the grand jury’s focus: a massive, over-budget renovation of the Federal Reserve’s headquarters – exceeding $1 billion – and Powell’s subsequent testimony before Congress regarding the project.

Judge Boasberg, in his original ruling, stated the Justice Department presented “no evidence whatsoever” of any crime committed by Powell, beyond allegedly displeasing the former President. He strongly suggested the subpoenas were designed to harass and coerce Powell.

The judge’s assessment pointed to a dominant, if not sole, purpose of intimidating Powell into either complying with the former President’s wishes or stepping down to allow for a more amenable replacement. This assessment fueled accusations of political interference.

The criminal inquiry, initiated by the U.S. Attorney for D.C., centered on Powell’s June testimony concerning the Fed’s extensive headquarters renovation. Powell himself publicly characterized the investigation as an attack on the Federal Reserve’s independence.

The U.S. Attorney publicly denounced the judge’s order as “outrageous,” claiming the judge improperly interfered with the grand jury’s process by “slamming the door shut” and preventing them from pursuing their investigation.

An appeal could significantly prolong the efforts to potentially replace Powell with a preferred candidate, former Fed Governor Kevin Warsh. This possibility has been openly discussed, highlighting the high stakes involved in this legal confrontation.

The core of the conflict revolves around accusations of political motivation behind a criminal investigation, raising serious questions about the independence of the Federal Reserve and the potential for executive overreach.
