A contentious bill aimed at protecting children from explicit online content met a decisive end in the Minnesota House, failing by a single vote. The measure, House File 1434, sought to require age verification on websites containing a significant amount of material deemed harmful to minors.

The vote concluded in a 67-67 tie, a stark partisan divide. Every Republican member present supported the legislation, while every Democrat opposed it, effectively killing the bill’s chances of becoming law.

The proposed legislation would have mandated that commercial websites – those with at least 25 percent content considered harmful to minors – verify the age of their users. This verification would be required before granting access to the site’s content.

Defining “harmful to minors” proved a key point of contention. The bill utilized a standard focusing on content lacking serious literary, artistic, political, or scientific value for young audiences.

Proponents emphasized built-in safeguards for data privacy, alongside enforcement mechanisms. The state Attorney General would have the power to enforce the law, and parents or guardians could pursue private lawsuits against non-compliant websites.

Had the bill passed, parents could have sought damages of up to $10,000 per violation, in addition to actual damages and legal fees, providing a direct avenue for recourse.

The debate surrounding the bill was lengthy, stretching back to the early stages of the legislative session. It ignited passionate arguments on both sides of the aisle, revealing deep ideological differences.

One particularly striking moment occurred during a debate when State Representative Leigh Finke voiced strong opposition. Finke argued that such content could be “educational,” specifically for young people exploring their gender identity.

Finke expressed concern that the bill’s broad definition of “prurient interest” could be weaponized to suppress content relevant to transgender youth, effectively denying them access to potentially valuable resources.

She further asserted that attorneys general in other states with similar laws have demonstrated a willingness to use them to restrict access to materials that could be considered educational for queer children, raising concerns about censorship and discrimination.
