The case against Tyler Robinson, accused in the shocking death of prominent conservative figure Charlie Kirk, is poised to move forward, even without crucial DNA evidence. Prosecutors have filed a notice stating they are prepared to proceed with a preliminary hearing on May 18th, regardless of whether the DNA analysis is finalized.

This development comes after Robinson’s defense team requested a six-month delay, citing incomplete and complex discovery materials. They argued the sheer volume of evidence required extensive processing, hindering their ability to adequately prepare.

However, prosecutors maintain they possess sufficient evidence beyond the DNA to establish probable cause. They initially intended to present the DNA findings at the hearing, but are now willing to proceed without it, prioritizing the case’s momentum.

A contentious point has emerged regarding ballistics testing. Robinson’s attorneys previously asserted that the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) could not definitively link a bullet recovered during the autopsy to a rifle allegedly connected to Robinson.

Prosecutors vehemently countered this claim, accusing the defense of misrepresenting the ATF report. They clarified that the ATF findings were “inconclusive,” meaning they couldn’t *exclude* the rifle as a potential source of the bullet – a critical distinction the defense omitted.

The ATF report itself explained that inconclusive results stem from a lack of sufficient identifiable characteristics on the bullet. This nuance, according to prosecutors, was deliberately downplayed to create a misleading narrative.

Robinson faces the most serious of charges, including aggravated murder, stemming from the alleged shooting on September 10, 2025. The severity of the accusations means he could potentially face the death penalty if convicted.

Judge Tony Graf is expected to rule on Friday regarding the scheduling of the preliminary hearing. The decision will determine whether the hearing proceeds as planned or is postponed, setting the stage for the next critical phase of this high-profile case.
