Federal lawyers contend that local law enforcement has failed to provide adequate assistance when requested, forcing federal agencies to divert resources from their core immigration-related duties to manage the ongoing unrest. The situation, they claim, demands federal intervention to restore order and protect its personnel. Oregon’s legal team counters that the president’s authority to federalize National Guard troops against a governor’s wishes is reserved for true emergencies – a last resort, not a response to ordinary challenges of governance. They argue the administration is overstepping its bounds and employing an “extraordinary measure” without sufficient justification. Adding another layer of complexity, a related case is currently before the Supreme Court. The court is considering whether to hear Trump’s appeal regarding National Guard deployment in Chicago.
