The long legal battle surrounding Senator Jose “Jinggoy” Estrada and the infamous Priority Development Assistance Fund (PDAF) has reached a decisive point. The Supreme Court, acting en banc, has dismissed a series of petitions filed by the Senator, effectively clearing the path for the continued prosecution of graft charges even after his acquittal on plunder allegations. The Court’s decision, delivered on October 28, 2025, and authored by Associate Justice Maria Filomena D. Singh, declared the petitions concerning the plunder cases as irrelevant. This followed the Sandiganbayan’s earlier acquittal of Estrada on plunder charges on January 19, 2024, rendering further debate on that specific count unnecessary. However, the dismissal didn’t extend to the separate graft charges. Estrada had argued these charges should be dismissed as they fell under the umbrella of the plunder accusations, but the Supreme Court firmly rejected this claim. The Court meticulously outlined the distinct nature of each crime. Plunder, they explained, centers on a public official’s direct and illicit enrichment. In Estrada’s case, this involved allegations of at least P183.79 million in kickbacks funneled through businesswoman Janet Lim Napoles. Estrada currently faces eleven counts of graft, linked to approximately P255.11 million of his PDAF funds, allegedly diverted through a network of foundations.
