A Georgia judge delivered a decisive blow to a Savannah city ordinance Wednesday, dismissing the case against Clayton Papp who had been cited for leaving a firearm in an unlocked vehicle. The judge’s ruling declared the ordinance a violation of both state law and the U.S. Constitution, igniting a debate over local gun control measures.

Papp was issued the citation in August, facing potential fines and jail time under the city’s rule prohibiting guns in unlocked cars. His attorney immediately challenged the ordinance, arguing its overreach and unconstitutionality within the framework of Georgia’s existing gun laws.

The ruling, issued by Chatham County Recorder's Court Judge Brian Joseph Huffman Jr., currently applies specifically to Papp’s case. He successfully challenged the ordinance as a direct defense against the criminal charge, a crucial distinction in its immediate impact.

Despite the setback, Savannah’s mayor remains steadfast in the city’s commitment to the ordinance. He emphasized its positive effect on reducing gun thefts from vehicles, citing a significant drop from over 200 reported incidents in 2023 to just over 100 this year.

The ordinance, unanimously approved by the Savannah city council last year, carried penalties of up to a $1,000 fine and 30 days in jail for violators. Supporters framed it as a responsible gun ownership measure, aiming to deter theft without infringing on Second Amendment rights.

Judge Huffman Jr. acknowledged the legitimate concerns regarding firearms stolen from vehicles and subsequently used in crimes. However, he firmly stated that good intentions alone cannot shield legislation from constitutional scrutiny, a cornerstone of American jurisprudence.

The judge’s ruling explicitly declared Savannah’s ordinance “void and unenforceable,” citing a direct conflict with a state law preventing local governments from regulating firearm possession, ownership, transport, or carrying. He further determined the ordinance placed an undue burden on Second Amendment rights.

Georgia’s Attorney General, Chris Carr, hailed the decision as a “major victory” for law-abiding gun owners. He argued that individuals should not be penalized for the criminal actions of thieves, a sentiment resonating with Second Amendment advocates across the state.

Legal experts suggest the ruling’s scope may be limited. Because the challenge arose within a criminal defense, the city could theoretically continue enforcing the ordinance, relying on individual defendants to raise the same constitutional questions.

A previous lawsuit attempting to halt the ordinance’s enforcement was dismissed by a different judge, who ruled the plaintiff lacked standing due to not being a Savannah resident and not having received a citation. This highlights the complexities of challenging local ordinances and the importance of direct harm.
