A stunning legal blow landed Monday as a federal judge dismissed the indictments against James Comey and Letitia James, unraveling cases that ignited fierce political debate. Judge Cameron Currie’s decision centered on a fundamental question of authority – whether the U.S. attorney who brought the charges was legitimately appointed.

The judge found the indictments were invalid because they originated with Lindsey Halligan, an interim U.S. attorney Currie deemed unqualified for the position. Charges of false statements against Comey and bank fraud against James were dismissed “without prejudice,” leaving open the possibility of future prosecution, but only with a properly appointed attorney.

Currie’s ruling detailed a flawed appointment process, stating the Attorney General’s attempt to install Halligan was “invalid” and that she had been unlawfully serving since September 22, 2025. This legal challenge struck at the heart of the Department of Justice’s pursuit of these high-profile cases.

The Department of Justice now faces a critical juncture: appeal the decision or re-present the charges with a legally sound U.S. attorney. The judge’s skepticism regarding Halligan’s authority had been brewing, culminating in this decisive dismissal.

To avoid conflicts of interest within Virginia, Judge Currie, appointed by President Clinton and based in South Carolina, was brought in to oversee the proceedings. The challenges from both Comey and James regarding Halligan’s appointment were combined due to their shared legal basis.

Halligan’s actions were particularly scrutinized. She acted independently in presenting the cases to a grand jury shortly after the previous interim U.S. attorney was removed from the position. Critically, she lacked prior prosecutorial experience and was the sole lawyer to present these significant indictments.

Despite the lack of local involvement, the Department of Justice staunchly defended Halligan’s actions. Attorney General Pam Bondi attempted to retroactively validate the indictments, a move Judge Currie suggested would have been unnecessary had Halligan been legitimately appointed from the outset.

During the hearing, a DOJ attorney characterized the challenge as a mere “paperwork error,” downplaying the severity of the appointment issue. However, James’ attorney forcefully argued that Halligan was an unauthorized individual within the grand jury rooms, possessing no legal standing to present charges.

The dismissal represents a significant setback for the DOJ and a potential turning point in these politically charged cases. The legal battle over the validity of the indictments has exposed deep questions about the process and authority within the Department of Justice.
