A legal battle is unfolding in Nevada, forcing Robinhood to temporarily halt its foray into sports prediction markets. A federal judge recently denied the company’s request for an injunction, effectively leaving them with no choice but to pause operations while the courts deliberate.

The decision stems from a ruling against Kalshi, another company attempting to offer similar contracts in the state. Judge Andrew Gordon’s judgment clarified that these prediction markets fall under Nevada’s strict wagering laws, requiring a license to operate legally.

Robinhood has agreed to cease offering new sports-related contracts in Nevada for the duration of any appeals process, and is actively working to close out existing open contracts. This move signifies a strategic retreat, at least for now, in the face of mounting legal pressure.

However, the situation isn’t uniform across the board. While Robinhood and Crypto.com have opted to comply, Kalshi is digging in its heels. They’ve refused to reach an agreement with the Nevada Gaming Control Board (NGCB) and are now seeking a stay of the judge’s ruling while they appeal.

The NGCB is prepared to vigorously oppose Kalshi’s motion, signaling a firm stance against unauthorized sports prediction activities within the state. They are determined to pursue legal action to halt what they deem unlawful conduct.

This isn’t an isolated incident. Nevada has consistently cracked down on various companies – including DraftKings, Flutter, Kalshi, Crypto.com, and now Robinhood – attempting to operate sports prediction markets without the necessary licensing. The state views these markets as a form of wagering, subject to its rigorous regulatory framework.

The NGCB has also issued a warning to all licensees, emphasizing that involvement in unlawful sports wagering, even in other states, could jeopardize their own suitability and integrity. Maintaining compliance with all applicable laws across all jurisdictions is paramount.

The core of the dispute lies in the interpretation of these prediction markets. The NGCB insists they constitute wagering, triggering the need for a license, while companies like Kalshi argue for a different classification. This fundamental disagreement is fueling the ongoing legal conflict.
