This isn’t a simple disagreement over facts; it’s an accusation of deliberate manipulation at the heart of a high-profile case.

The motion details a disturbing narrative: Bertino initially told the government the events of January 6th were spontaneous and lacked pre-planning. However, he alleges he was threatened with a 25-year prison sentence unless he changed his story to align with the prosecution’s claim of a premeditated conspiracy.

This claim isn’t based on hearsay. Rehl’s filing includes a sworn affidavit from Bertino himself, alongside audio and video recordings where the witness recants his previous trial testimony. He now expresses deep regret for altering his account, stating unequivocally that no prior planning existed among the defendants.

Adding another layer of complexity, the lead prosecutor in the case, Jason McCullough, was reportedly removed from his position shortly after the convictions, amidst a broader shift within the Department of Justice. This timing suggests an internal acknowledgment of potential ethical breaches.

Rehl swiftly followed up his initial filing with a supplemental motion, correcting minor details and, crucially, attaching Bertino’s damning affidavit as direct evidence. The affidavit paints a vivid picture of relentless pressure from prosecutors, who allegedly “coached” Bertino to reinterpret social media posts as proof of intent.

Rehl and his co-defendants previously alleged “outrageous government conduct,” including evidence suppression and false testimony, but that motion was dismissed due to pending appeals.
