NY SHUTS DOWN Anti-Trans Bathroom Ban—Another Victory!

A second Long Island school district has been stopped in its tracks, prevented from enacting a policy that would have restricted bathroom access for transgender students. The state intervened, halting the Locust Valley School District’s attempt to enforce a ban based on assigned sex at birth.

Locust Valley had recently adopted a resolution mirroring one passed weeks earlier in Massapequa – a move that immediately drew scrutiny. The district aimed to require students to use facilities aligning with their biological sex, but state Education Commissioner Betty Rosa issued an order last month effectively nullifying that plan.

The Commissioner’s directive is clear: Locust Valley must adhere to the state’s interpretation of the law, which affirms a student’s right to use bathrooms and locker rooms consistent with their gender identity. This ruling arrives as a legal battle continues in Massapequa, where the New York Civil Liberties Union is challenging the district’s similar policy on behalf of a transgender student.

Locust Valley has now been formally linked to the Massapequa case due to the striking similarities in their policies. The outcome of the Massapequa lawsuit, which saw the district file a federal suit against the student’s parents and state officials, could directly influence the fate of Locust Valley’s policy.

District officials defending the ban cited Title IX, the federal law prohibiting sex-based discrimination, and a previous executive order defining sex as strictly male or female. They argued this justified restricting access based on assigned sex at birth, and expressed concern over potential loss of federal funding.

However, state officials maintain that New York law explicitly protects the rights of transgender students, allowing them to use facilities that align with their gender identity. The Locust Valley School Board acknowledges the “complex and evolving legal landscape” and is seeking further legal guidance in response to the Commissioner’s order.

This situation underscores a growing tension between federal and state interpretations of gender identity and student rights, leaving school districts caught in the middle of a rapidly changing legal battleground. The implications extend far beyond these two districts, signaling a broader struggle over inclusivity and equal access for all students.
