A legal battle is escalating, with Judge James Boasberg signaling a potential “contempt prosecution” linked to the deportation of individuals under the Alien Enemies Act. The judge is intensifying an inquiry into the actions of the previous administration, focusing on whether court orders were deliberately defied.

The core of the dispute centers around deportation flights that proceeded in March, despite a direct emergency order from Judge Boasberg. Recent disclosures revealed that the then-Secretary of Homeland Security authorized these flights, setting the stage for a direct confrontation with the judiciary.

Judge Boasberg has demanded a comprehensive accounting from the previous administration, requesting declarations from everyone involved in the decision to continue the deportations. A deadline of December 5th was set for the submission of these crucial documents, aiming to establish a clear timeline of events.

While the judge deemed it “premature” to immediately recommend criminal prosecution for the former Homeland Security Secretary, he issued a compelling summons. Two high-ranking Justice Department lawyers directly involved in the deportation operation are now required to testify next week.

This escalation follows a recent decision by a federal appeals court to lift the hold on Boasberg’s contempt inquiry, effectively clearing the path for a full investigation. The judge is now aggressively pursuing information from administration officials.

The initial legal challenge arose in March when Judge Boasberg issued a temporary restraining order, attempting to halt the deportation of thousands of Venezuelan nationals suspected of ties to the notorious Tren de Aragua gang. The administration sought to utilize the Alien Enemies Act in these removals.

The Supreme Court ultimately vacated Boasberg’s orders, citing a lack of jurisdiction. However, the high court stipulated that the administration must provide reasonable notice to allow individuals facing deportation an opportunity to challenge their removal in court.

Undeterred, Judge Boasberg expressed concern that the administration was not making efforts to return individuals previously deported. He suggested a willingness to pursue legal action to compel their return to the United States.

The judge has already found probable cause to believe the previous administration acted in criminal contempt of court, deliberately disregarding his order to halt the deportation flights. A detailed 46-page opinion outlined what he characterized as a “willful defiance” of the judicial system.

Judge Boasberg has reserved the right to appoint a special prosecutor if the Justice Department does not pursue criminal contempt charges independently. This move underscores the seriousness of the situation and the judge’s determination to hold those responsible accountable.
