A former hotel licensee in New South Wales, Australia, faced a hefty penalty – a $44,000 AUD fine – for a quiet defiance of gambling regulations. The breach wasn’t a grand scheme, but a series of 68 instances where gaming machines whirred to life during legally mandated shutdown hours.

An investigation by Liquor & Gaming NSW revealed the illicit activity occurred at the former Richards on the Park Hotel between May 2022 and September 2023. Beyond the substantial fine, Kelly Rice, the former licensee, was also ordered to cover $2,537.42 in associated costs, a stark reminder of the consequences.

Rice immediately acknowledged the wrongdoing, expressing sincere remorse and a desire for swift resolution. His defense centered on a genuine, though incorrect, belief that the gaming room was permitted to operate until 5:00 am on Sundays, mirroring the practices of the previous management.

The rationale is simple: limiting access during those vulnerable hours can curb unhealthy gambling behaviors. This initiative aligns with a broader movement to protect communities and reduce the risks associated with excessive gambling, a concern that’s gaining momentum globally.

Further strengthening these protections, regulations taking effect in March 2026 will eliminate any existing exceptions to these shutdown hours, solidifying the commitment to harm minimization. The message is clear – these rules are not suggestions.

Dimitri Argeres, Executive Director of Regulatory Operations at Liquor & Gaming NSW, emphasized the gravity of the breach. “Compliance is not optional,” he stated, underscoring the seriousness with which these regulations are viewed.

The risk isn’t merely financial; operating during shutdown hours significantly elevates the potential for gambling harm, particularly in areas already identified as vulnerable. This case serves as a powerful reinforcement of accountability within the industry.

NSW employs a centralized monitoring system connected to all gaming machines, providing a constant stream of data used for investigations and enforcement. This technology ensures transparency and allows authorities to swiftly identify and address violations.

The Richards on the Park Hotel has since undergone a change in ownership, and Kelly Rice is no longer affiliated with the establishment. However, the repercussions of his actions stand as a cautionary tale for all licensees.
