A late-night collision in Zebulon, North Carolina, has spiraled into a complex legal battle for 27-year-old Austin Herber, now facing a stunning array of charges including hate crimes and kidnapping. The incident began with a forceful impact, a black car allegedly ramming into Herber’s white truck before attempting to escape.

According to arrest warrants, the aftermath of the crash unleashed a series of escalating events. Herber is accused of assault inflicting serious injury, assault and battery, and menacing others with a firearm. The charges extend to two counts each of kidnapping, communicating threats, and a particularly serious allegation: ethnic intimidation.

Surveillance footage captured the initial impact, showing the black car veering off the road and colliding with Herber’s truck. The scene quickly descended into chaos as those involved reacted to the sudden violence.

Emma Larson, a passenger in Herber’s truck, recounted a terrifying experience. She described being knocked unconscious by the crash and waking up covered in blood, witnessing the occupants of the other vehicle attempting to flee the scene. She required seven stitches to her mouth and face.

Investigators report that three men were inside the black car, with the driver immediately leaving before law enforcement arrived. Two men later reported being assaulted, claiming Herber repeatedly kicked and struck one of them in the head, causing significant injuries.

The warrants allege Herber brandished a 9mm handgun, pointing it at the men without justification and issuing threats that instilled fear of imminent violence. The most contentious accusations center on the claim that this aggression was fueled by racial animus, targeting the men based on their ethnicity.

Jessica Thompson, owner of Smash Masters, the bar Herber and Larson had just left, offers a dramatically different account. She arrived shortly before the crash and remained at the scene until police arrived, disputing the severity of the charges.

Thompson stated she witnessed Herber attempting to restrain the individuals, instructing them not to leave as they tried to escape. She emphatically denies seeing a firearm or witnessing any physical assault with a weapon. Her recollection paints a picture of Herber attempting to hold the fleeing individuals accountable.

According to Thompson, Herber simply approached the men and physically guided them back to the ground, preventing their departure. This account directly contradicts the allegations of violent assault and intimidation.

The Zebulon Police Department has remained tight-lipped, refusing to elaborate on the basis for the hate-crime allegations or the charge of terrorizing others with a firearm. This lack of transparency has fueled questions surrounding the investigation and the charges filed against Herber.

The case has quickly drawn attention, sparking debate and raising questions about the interpretation of events and the application of hate-crime laws. The conflicting accounts and the police department’s silence leave many details shrouded in uncertainty.
