However, the most unsettling revelation came during questioning about the ES&S DS200 system. Parikh confirmed he *had* hacked into the DS200, and was actively attempting to gain full control – not just access, but the ability to manipulate the core statistical data.

He was stopped before completing this critical step. His intention was to demonstrate how election results could be altered *before* reaching the official tally. The question lingered: why would a testing lab halt an investigation into such a profound vulnerability?

The answer lies in who funds these labs. They aren’t independent entities appointed by the state, but are contracted directly by the voting machine vendors themselves. This creates an inherent conflict of interest, potentially prioritizing vendor protection over genuine security testing.

But the landscape has begun to shift. Buried within the National Defense Authorization Act, signed in December 2025, lies Section 6805: a mandate for penetration testing of voting systems.

This amendment to the Help America Vote Act now requires accredited laboratories to conduct rigorous cybersecurity assessments as a condition of certification by the U.S. Election Assistance Commission. It even allows for collaboration with federal agencies like the National Institute of Standards and Technology.

While not a complete solution, this new requirement represents a crucial step forward. It finally empowers cybersecurity experts to perform the kind of in-depth testing that individuals like Clay Parikh were previously prevented from completing.

The ultimate safeguard, however, remains a return to fundamental principles. In Dallas County, Texas, the 2026 midterm primaries will utilize hand-marked paper ballots, counted directly at the precinct level – a method championed by those dedicated to ensuring truly free and fair elections.
