TRUMP'S MILITARY TAKEOVER OF CHICAGO HALTED—But It's FAR From Over!

The Supreme Court delivered a significant blow to a controversial initiative this week, maintaining a block on the deployment of National Guard troops to the Chicago area.

In a 6-3 decision, the Justices rejected a request from the previous administration to halt a lower court’s order, effectively keeping federalized troops off the streets of Illinois for the time being.

The core of the dispute centered on the administration’s attempt to utilize the National Guard to bolster enforcement of federal immigration laws, a move fiercely opposed by Illinois’ governor.

A federal judge initially issued a temporary restraining order in October, arguing the deployment would violate the Posse Comitatus Act, a law restricting the use of the military for domestic law enforcement purposes, as well as constitutional amendments concerning states’ rights and equal protection.

The administration contended that the courts shouldn’t question the President’s authority to federalize the National Guard, asserting a clear right to call upon these forces for federal service.

However, the Supreme Court disagreed, allowing the lower court’s decision to stand, a move signaling a reluctance to intervene in the balance of power between the federal government and the states.

Justices Thomas, Alito, and Gorsuch registered their dissent, indicating a disagreement with the majority’s stance on presidential authority and the scope of federal power.

The legal challenge arose from a previous mobilization of Texas National Guard troops sent to Chicago, ostensibly to protect Immigration and Customs Enforcement (ICE) agents.

The appeals court, in a unanimous decision, reinforced the initial judge’s ruling, finding “insufficient evidence of rebellion or a danger of rebellion” to justify the troop deployment.

This ruling represents a critical moment in the ongoing debate over the limits of presidential power and the role of the military within domestic borders, leaving the future of federal intervention in local law enforcement uncertain.
