A legal battle is intensifying as a federal judge demands answers from Lindsey Halligan regarding her continued use of the title “U.S. Attorney” for the Eastern District of Virginia. Judge David Novak issued an order this week, compelling Halligan to justify her actions in a criminal indictment, despite a previous ruling deeming her appointment illegitimate.

The judge’s three-page order doesn’t simply question the title; it asks Halligan to explain why her use of it shouldn’t be removed from the indictment altogether. Novak specifically wants a written explanation within seven days, probing whether her self-identification constitutes a false or misleading statement to the court.

This isn’t an isolated incident. Halligan was appointed by former President Donald Trump following the resignation of Erik Siebert. However, a November ruling already cast a shadow over her authority, dismissing indictments against high-profile figures like former FBI Director James Comey and New York Attorney General Letitia James.

The previous ruling, delivered by Judge Cameron McGowan Currie, found Halligan’s appointment unlawful, stripping her of the power to pursue those charges. While that decision is currently under appeal, it remains in effect, binding the court’s actions until overturned.

The situation highlights a broader struggle over judicial appointments and the confirmation process. Former President Trump publicly criticized the Senate’s “blue slip” tradition, claiming it unfairly blocked qualified Republican nominees, allowing only far-left Democrats to gain approval.

Trump argued the practice was “not Constitutional” and urged Senate Majority Leader John Thune to dismantle it, expressing frustration that “GREAT REPUBLICANS are being, SENT PACKIN’.” He believes the system systematically disadvantages Republican candidates.

Halligan isn’t the only Trump-appointed U.S. Attorney facing scrutiny. Alina Habba, another appointee, recently announced her resignation as the top federal prosecutor in New Jersey after a similar appeals court ruling invalidated her position.

Habba’s departure followed a determination that she, too, was unlawfully serving in her role, adding another layer to the ongoing legal challenges surrounding these appointments and raising questions about the validity of cases pursued under their authority.

The judge’s order to Halligan represents a significant escalation, demanding a direct accounting for her actions and potentially jeopardizing the integrity of any ongoing cases she’s involved in. The coming days will be crucial as she prepares her response and the court weighs the implications.
