A dramatic legal battle is unfolding between Kalshi, a prediction market operator, and the Tennessee Sports Wagering Council. Kalshi has secured a temporary restraining order against the Council, alleging a deliberate shutdown despite repeated attempts at open communication.

The conflict began with Kalshi’s efforts to engage Tennessee officials in a dialogue regarding its operations. These attempts, spanning several months, were consistently rebuffed, culminating in a cease-and-desist letter demanding Kalshi halt all activity within the state.

The lawsuit, filed on January 9th, details Kalshi’s frustration with the Council’s unwillingness to discuss the matter. Emails reveal a representative from Kalshi reaching out to a high-ranking Tennessee official, only to receive a response indicating no immediate willingness to engage.

Just three days after that email exchange, the cease-and-desist letter arrived, a move Kalshi argues was a sudden and unexpected escalation. The company claims it believed the Council had previously indicated no enforcement action was planned.

The judge, recognizing the potential for irreparable harm, granted the temporary restraining order. The court reasoned that Kalshi is likely to succeed in its argument that Tennessee’s laws are preempted by federal regulations.

At the heart of the dispute lies the question of regulatory oversight. Kalshi maintains that its operations fall under the jurisdiction of the Commodity Futures Trading Commission (CFTC), not individual state sports wagering councils.

This isn’t an isolated incident for Kalshi. The company has previously faced similar legal challenges in Nevada, New York, and Connecticut, consistently asserting the CFTC’s authority over prediction markets.

Kalshi’s legal strategy centers on the idea that a unified, federal approach to regulating these markets is essential. The outcome of this case could have significant implications for the future of prediction markets across the United States.

A hearing is scheduled for January 12th, where the court will further consider the merits of Kalshi’s claims and determine whether to extend the temporary restraining order. The case is being overseen by Judge Aleta A. Trauger in the Middle District of Tennessee.
