The fate of this push hinges on an obscure Senate rule, a tactic once favored by Democrats, now potentially wielded by Republicans to silence debate.

The core of the dispute centers around a war powers resolution spearheaded by Senator Tim Kaine. It aims to establish Congressional oversight for any future military actions in Venezuela, a move proponents believe is crucial for accountability. Republicans, however, are questioning the very necessity of the resolution.

Their argument rests on a simple claim: there are currently no U.S. troops engaged in active combat within Venezuela. They intend to use a point of order – a procedural maneuver – to declare Kaine’s resolution irrelevant, effectively killing it before it can reach a vote. This hinges on convincing a majority of the Senate that no immediate threat exists.

The success of this maneuver is far from guaranteed. Last week, five Republicans defied party lines to support advancing the war powers resolution, creating a precarious balance of power. A simple 50-vote majority will determine whether the resolution lives or dies, and Senate Majority Leader John Thune admits the outcome is “uncertain.”

This isn’t the first time this tactic has been employed. Senate Democrats successfully used a similar point of order in 2024 to block a resolution concerning U.S. involvement with a pier operation off the coast of Gaza, arguing no immediate hostilities existed. The current situation, however, is different.

Kaine’s resolution isn’t focused on past actions, but on preventing future, unauthorized military intervention. The Trump administration insists no further deployments to Venezuela are planned, following the completion of “Operation Absolute Resolve,” and has reportedly offered assurances to wavering Republicans.

The coming days will be a test of leadership and lobbying prowess. Senate GOP leaders and the White House are working to sway the five Republicans who previously opposed the administration’s stance. However, Trump’s public criticism of these senators could prove counterproductive, potentially solidifying their opposition.

All eyes are on Senators Susan Collins, Lisa Murkowski, Todd Young, Josh Hawley, and Rand Paul. Collins has reaffirmed her support for the resolution, and Paul, a co-sponsor, appears steadfast. But a recent shift suggests vulnerability within the group.

Senator Hawley, it’s been reported, has altered his position, now leaning towards supporting the point of order after receiving direct assurances from Trump officials regarding the absence of troops on the ground. The outcome now rests on a knife's edge, a testament to the intricate and often unpredictable nature of Senate procedure.
