A federal judge has delivered a scathing rebuke to U.S. Immigration and Customs Enforcement, finding the agency acted illegally when detaining a man in Iowa despite a court order for his release. The ruling reveals a deliberate attempt by ICE to justify an unlawful arrest, raising serious questions about the agency’s adherence to federal law.
The case centers on Jorge Eliecer Gonzalez Ochoa, a Colombian native who sought refuge in the United States after facing threats to his family. Judge Stephen Locher determined that ICE lacked the legal authority to hold Gonzalez Ochoa on December 23rd, as they hadn’t yet filed a crucial document – the “Notice to Appear” – required to initiate deportation proceedings.
While ICE eventually issued the Notice to Appear, the judge wasn’t swayed. Locher found the timing suspicious, noting the agency mailed the document rather than serving it directly while Gonzalez Ochoa was in custody. This maneuver, the judge asserted, appeared to be a calculated effort to conceal the sequence of events.
The judge’s order is blunt: ICE “knew it should not have issued the arrest warrant” without the necessary paperwork and then attempted to “cover its tracks.” Locher emphasized that Gonzalez Ochoa should have been released as mandated by the court, not subjected to a frantic scramble to retroactively legitimize his detention.
Although immediate release wasn’t ordered, the judge mandated an individualized bond hearing within seven days, granting Gonzalez Ochoa the opportunity to argue for his release on bail. This hearing will allow a deeper examination of his case and the circumstances surrounding his detention.
Gonzalez Ochoa’s initial immigration proceedings were dismissed in 2025 at the request of the Department of Homeland Security. However, he subsequently faced criminal charges in Iowa, including fraud and misuse of documents, leading to his continued detention until a judge ordered his release in December – a release ICE then defied.
The judge’s ruling isn’t simply a legal technicality; it’s a condemnation of what appears to be a deliberate disregard for due process. It highlights the potential for abuse within the immigration system and underscores the importance of holding government agencies accountable for upholding the law.
