A young man in British Columbia, working in Canada on a permit, faced a courtroom decision that hung in the balance – his future in the country, and the consequences for a violent act against his girlfriend.

Joyson Lewis, 25, admitted to assaulting his girlfriend during an altercation that escalated within a vehicle last April. The incident didn’t end when she escaped the car; Lewis pursued her, physically grabbing her and causing damage to her belongings.

The Crown detailed in court how Lewis tore her shirt and damaged her phone before ultimately striking her, the attack only halted by the intervention of a concerned friend. The prosecution initially requested a nine-month probationary period as punishment for his actions.

However, Lewis’s lawyer argued for a conditional discharge, a ruling that would prevent the conviction from appearing on his record. This wasn’t a guarantee of staying in Canada, but it would remove the automatic barrier to immigration and allow him to plead his case.

Two additional charges of domestic assault involving the same woman, from separate incidents months prior, were dropped as part of the sentencing agreement. These incidents painted a troubling pattern of behavior, adding weight to the gravity of the situation.

Lewis had arrived in Kamloops in 2021 as a student, and now supports his ailing mother in Mumbai by sending money home each month from his restaurant job. His dream was to secure permanent residency and build a life in Canada.

Before the judge, Lewis expressed deep remorse, taking full responsibility for his actions and pledging to attend counseling and take any necessary steps to remain in the country. He conveyed sincere regret for the harm he had caused.

Judge Ray Phillips ultimately imposed a nine-month probation, with a crucial condition: successful completion of the term would result in the conviction being removed from his record. This offered Lewis a path forward, a second chance to pursue his aspirations.

The judge acknowledged Lewis’s proactive response, his willingness to address the root causes of his anger and disrespect, and his commitment to change. However, the probation also included strict conditions – no contact with the victim and a prohibition on possessing weapons.

The ruling represents a complex intersection of justice, immigration, and personal responsibility, leaving Lewis with an opportunity to rebuild his life while acknowledging the pain he inflicted.
