This isn’t the first time Judge Cobb has intervened in this specific dispute. Last month, she declined to halt enforcement of the week-long notice requirement, citing a technicality in the legal approach. However, she had previously, in December, temporarily blocked a similar administration policy, deeming it likely unlawful to demand advance notice for facility visits.

The judge’s December ruling underscored a fundamental principle: members of Congress have a right to observe conditions within ICE facilities firsthand, without undue obstruction. The latest decision reinforces that principle, signaling a willingness to protect congressional oversight powers and ensure transparency in immigration detention practices.

The temporary restraining order represents a crucial victory for congressional Democrats seeking greater access and accountability. It allows for immediate, unannounced inspections, potentially revealing critical information about the treatment of individuals in immigration custody and the operations of these facilities.
