A directive issued this week has dramatically altered the Department of Labor’s relationship with the American Bar Association. Solicitor Jonathan Berry, appointed during the previous administration, instructed staff to cease all official engagement with the organization.

Berry’s decision stems from a belief that the ABA has drifted from its stated non-partisan role, actively pursuing what he characterizes as a “liberal activist” agenda. He argues that federal participation inadvertently lends legitimacy and influence to these ideological positions.

The core of Berry’s concern lies in the ABA’s perceived inconsistency. While presenting itself as neutral, the organization consistently adopts stances on contentious issues that align with progressive viewpoints, effectively leveraging its “neutral” platform to advance specific goals.

This isn’t simply about differing opinions; Berry contends that continued engagement would actively contribute to the ABA’s ability to promote these “radical” positions under the guise of objectivity. He has therefore issued a firm directive: no further taxpayer-funded participation in ABA events, nor the use of official titles within the organization.

The ABA, a voluntary association representing over 1.3 million lawyers, traditionally focuses on upholding the rule of law, professional standards, and access to justice. However, its recent policy positions have drawn significant criticism from those who believe it has overstepped its bounds.

Among the areas of contention is the ABA’s strong advocacy for abortion access, consistently opposing restrictions on reproductive rights and actively supporting legal protections for both providers and patients. This stance has become particularly prominent following the overturning of Roe v. Wade.

The organization also champions LGBTQ+ rights, including gender-affirming care for minors and transgender individuals, advocating for non-discrimination protections. These positions, while supported by many, are viewed by others as representing a clear ideological leaning.

Further fueling the controversy is the ABA’s stance on gun control, actively promoting measures like expanded background checks and bans on certain types of firearms. This advocacy is framed as a public safety initiative, but critics see it as a partisan political position.

Diversity, Equity, and Inclusion (DEI) initiatives within the ABA have also sparked debate. The organization now requires law schools to prioritize DEI in admissions and hiring, a move some argue enforces a specific ideology and potentially conflicts with anti-discrimination laws.

The ABA’s collaborative efforts with organizations like the ACLU, NAACP Legal Defense Fund, and Lambda Legal on issues ranging from voting rights to immigration reform further underscore its alignment with progressive causes. These partnerships raise questions about its neutrality.

Concerns extend to the ABA’s judicial ratings system, which has been accused of unfairly downgrading conservative nominees while favoring liberal candidates. This perceived bias led to a previous decision by the Justice Department to cease compliance with the ABA’s rating process.

A letter from a former U.S. Attorney General detailed decades of “special treatment” afforded to the ABA, including early access to judicial nominee information and, in some cases, allowing ABA ratings to directly influence nomination decisions. This history contributed to the growing skepticism surrounding the organization’s objectivity.
