Governor Greg Gianforte and Attorney General Austin Knudsen, both Republicans, are prepared to enforce SB 200, a law allowing civil legal action and fines against any jurisdiction found to be obstructing cooperation with federal immigration enforcement. Gianforte emphasized a zero-tolerance approach, stating Montana will not “tolerate defiance” and fully supports its law enforcement officers.
The investigation was triggered by a recent vote by Helena City Commissioners to limit local coordination with federal immigration enforcement. Officials believe this action potentially breaches the sanctuary city ban, originally championed by state Representative Kenneth Holmlund, and raises serious concerns about compliance with state law.
The core of the dispute lies in a resolution passed by the Helena City Council, which directs local officers to refrain from assisting federal agencies in immigration-related actions or detaining individuals solely based on suspected immigration violations. Gianforte argues this resolution is a deliberate attempt to hinder federal law enforcement operations.
Attorney General Knudsen expressed strong disapproval, suggesting Helena is openly disregarding the authority of the Montana Legislature and failing to recognize its limited power to create law. He advised the city to seek legal counsel and consider engaging a lobbyist to navigate the impending legal challenges.
Helena city officials, while acknowledging the situation, have yet to receive formal notification of the investigation. They maintain that the resolution was carefully crafted to align with all applicable legal requirements at the local, state, and federal levels, and that the city remains committed to upholding all laws.
While the initial focus is on Helena, the investigation casts a wider shadow, with reports suggesting concerns are also surfacing regarding Missoula, Montana’s second-largest city. Missoula officials, however, assert they have never operated as a sanctuary city and that their police officers do not inquire about immigration status during routine public interactions.
The governor’s rationale for this aggressive enforcement stems from a desire to reinforce border security, referencing past administrations and the perceived influx of undocumented immigrants.
