A legal battle is escalating between Nevada gaming regulators and Kalshi, a company operating an online marketplace where users can trade contracts based on the outcomes of future events. The dispute reached a critical point as Nevada filed a civil lawsuit, swiftly following a federal appeals court’s refusal to temporarily halt the proceedings.

The Nevada Gaming Control Board’s complaint, lodged in Carson City, seeks a definitive court order and injunction to prevent Kalshi from offering what regulators deem unlicensed wagering within the state. At the heart of the conflict lies Kalshi’s platform, which allows the buying and selling of “event contracts” – essentially predictions on future occurrences – accessible through both a website and mobile application to Nevada residents.

Regulators contend that certain offerings on Kalshi’s platform constitute illegal wagering under Nevada law, requiring a state license to operate. Specifically, contracts tied to sporting events and other uncertain outcomes are being challenged, with the state citing multiple Nevada Revised Statutes related to licensing and preventing game manipulation.

Mike Dreitzer, Chairman of the Nevada Gaming Control Board, emphasized the state’s commitment to protecting residents and maintaining the integrity of Nevada’s established gaming industry. The Board views Kalshi’s activities as a direct threat to these principles, necessitating strong legal action.

The lawsuit alleges that Kalshi’s marketplace functions as both a gambling game and a sports pool, accepting wagers from within Nevada. Regulators argue the platform meets the state’s definition of a sports pool by facilitating bets on uncertain events, and further classifies it as a “percentage game” due to the trading fees Kalshi collects.

Nevada law explicitly prohibits offering games or sports pools without the necessary gaming licenses. The state is requesting the court to declare that existing statutes prevent Kalshi from providing these event-based contracts without proper authorization and to enforce an injunction to immediately cease such operations.

Kalshi has responded by shifting the legal arena to federal court, arguing the dispute involves significant federal questions. The company asserts its operations fall under the exclusive jurisdiction of the Commodity Futures Trading Commission (CFTC) as a federally regulated derivatives exchange.

Kalshi describes itself as a financial services company operating under federal oversight, subject to the rules governing designated contract markets. The company contends that Nevada’s claims hinge on resolving whether a federally regulated exchange can simultaneously be considered a “sports pool” under state law, a question of federal importance.

Adding another layer to the complexity, Kalshi alleges Nevada proceeded with the lawsuit despite a written agreement not to initiate enforcement while the Ninth Circuit Court of Appeals considered a related stay motion. This move has further intensified the legal standoff.

The timing of this legal action coincides with signals of support from the CFTC for federally regulated prediction markets operating across state lines. The agency, under its chairman, has indicated that these markets may be exempt from state gaming laws, falling instead under federal commodities law.

This position, articulated in arguments related to other litigation, suggests the CFTC views approved prediction market contracts as financial derivatives, not traditional sports betting, potentially preempting state-by-state regulation. The outcome of this case could have far-reaching implications for the future of prediction markets and the balance of power between state and federal regulators.
