The 6-3 ruling effectively dismantled a key element of his economic strategy, a move that will reshape the landscape of international trade and presidential power.

At the heart of the dispute lay the question of constitutional authority. The court, with a clear majority comprised of Justices Roberts, Sotomayor, Kagan, Gorsuch, Barrett, and Jackson, asserted that the power to impose taxes – including tariffs – “very clearly” resides with Congress, not the Executive Branch. This fundamental principle, they argued, was a cornerstone of the nation’s founding.

Chief Justice Roberts, writing for the majority, underscored that the Framers deliberately withheld the taxing power from the President. This decision directly challenged the Trump administration’s reliance on a 1977 law allowing presidential regulation of imports during emergencies, a law they had stretched to justify broad tariff implementation.

Justices Alito, Thomas, and Kavanaugh vehemently dissented, arguing the tariffs were “clearly lawful” based on text, history, and precedent. Justice Kavanaugh, in particular, maintained that while the wisdom of the tariffs might be debated, their legality was undeniable. This sharp division highlighted the deep ideological fissures within the court.

This ruling marks the first significant check on a major Trump initiative to reach the Supreme Court, a court notably shaped by three of his own appointments. The irony was palpable, as the very institution he sought to influence now curtailed one of his most assertive policies.

Despite this setback, the administration signaled its intent to continue utilizing tariffs, albeit under different legal authorities. While these alternative avenues offer less expansive power than the emergency law, officials anticipate maintaining a tariff framework, albeit with more limitations on speed and scope.

The case unfolded against a backdrop of public skepticism regarding tariffs. Polling data consistently revealed widespread concern about affordability, suggesting the administration’s economic policies were not resonating with the broader population. Trump himself had publicly warned of dire economic consequences should the court rule against him.

The Trump administration initially invoked the 1977 law in April, imposing “reciprocal tariffs” on numerous countries in response to perceived trade deficits, framing these deficits as a national emergency. Prior to this, tariffs were levied on Canada, China, and Mexico, justified by the administration as a response to a drug trafficking emergency.

The economic impact of these tariffs has been substantial. The Congressional Budget Office estimated a staggering $3 trillion loss over the next decade. As of December, the U.S. Treasury had already collected over $133 million from tariffs imposed under the contested emergency powers law, a figure that now faces reevaluation in light of the Supreme Court’s decision.

While past presidents had utilized the 1977 law for targeted sanctions, Trump’s application represented a radical departure, extending its reach to broad-based import taxes. This aggressive use of executive power ultimately proved to be a bridge too far, colliding with the constitutional principles upheld by the Supreme Court.
