A dramatic clash between the Executive Branch and the Supreme Court unfolded Friday, as President Trump vowed to circumvent a recent ruling against his tariff policies. Just hours after the court struck down his use of emergency powers to impose a global levy, he announced a new 10% tariff, promising swift implementation.

The President’s defiance stemmed from the court’s 6-3 decision, asserting that the power to impose tariffs – essentially taxes – rests solely with Congress. The majority opinion, penned by Chief Justice Roberts, underscored the constitutional framework established by the nation’s founders, explicitly denying the Executive Branch such authority.

Trump, however, dismissed the ruling as “incorrect” and “deeply disappointing,” even going so far as to label some justices “unpatriotic” and “disloyal.” He immediately signaled his intent to utilize Section 122 of the 1974 Trade Act, a move that would allow the tariff to take effect within three days, though ultimately requiring congressional approval for long-term continuation.

The initial tariffs were justified under the 1977 International Emergency Economic Powers Act, claiming a national emergency. This justification, however, failed to persuade the court, which firmly reasserted Congress’s constitutional role in matters of taxation. The dissenting justices argued the tariffs were lawful, regardless of their potential wisdom.

This ruling marks a significant moment, representing the first major check on Trump’s agenda by a Supreme Court he actively shaped with three conservative appointments. Despite previous short-term victories on emergency appeals, the court has now delivered a decisive blow to his unilateral exercise of power.

Across the border, the reaction in Canada was swift and varied. While Prime Minister Carney remained publicly silent, opposition leader Pierre Poilievre hailed the court’s decision as a “step in the right direction,” but cautioned that existing tariffs on key Canadian exports – steel, aluminum, lumber, and automobiles – remained a critical concern.

Ontario Premier Doug Ford echoed this sentiment, calling the ruling an “important victory,” but emphasizing the ongoing “battle” to eliminate all tariffs impacting Canadian industries and workers. He pledged continued advocacy for a complete removal of trade barriers.

Business groups also weighed in, with the Canadian Federation of Independent Business welcoming the ruling as a positive development for small businesses on both sides of the border. However, they stressed the continued uncertainty surrounding trade relations and the persistent impact of existing tariffs.

The President’s initial tariffs, imposed in April, were framed as a response to trade deficits and alleged national security concerns. The Congressional Budget Office estimates the economic impact of these tariffs could reach $3 trillion over the next decade, while the U.S. Treasury has already collected over $133 million from them.

The future of trade between the U.S. and its partners remains uncertain. As the new tariff takes effect, and with the renegotiation of the Canada-U.S.-Mexico Agreement looming, the stage is set for further economic and political maneuvering.
