Luigi Mangione will not face the death penalty. A stunning reversal by federal prosecutors on Friday means the accused killer’s life will be spared, at least from federal charges. The decision follows a judge’s ruling that effectively dismantled the capital punishment case against him.

The U.S. Attorney’s Office for the Southern District formally accepted Judge Margarett Garnett’s January 30th decision. This ruling tossed out the murder charge that carried the possibility of execution, stemming from the fatal shooting of UnitedHealthCare CEO Brian Thompson. While the most severe penalty is off the table, Mangione is far from free.

He still faces two federal stalking charges, with jury selection slated to begin September 8th. The trial itself, where these charges will be presented, is expected to commence in October. This legal maneuvering doesn’t end here, however.

A separate, state-level murder trial awaits Mangione in June, where he could still face a life sentence. He has entered a plea of not guilty in connection with Thompson’s death. The legal complexities surrounding the federal charge proved insurmountable.

Judge Garnett determined that prosecutors needed to demonstrate an underlying crime of violence to pursue the federal murder charge involving a firearm. Her decision hinged on a series of Supreme Court precedents, forcing a narrow interpretation of the law. She explained the court was bound by decades of evolving legal interpretation.

Garnett described a legal landscape where courts must analyze the “hypothetically least serious conduct” a crime could encompass, rather than focusing on the actual events. This abstract legal requirement ultimately undermined the prosecution’s case. The details of the crime itself are chilling.

Surveillance cameras captured the entire horrifying event. Footage shows Brian Thompson walking on a Manhattan sidewalk near a hotel when a gunman silently approached from behind. Without warning, the gunman opened fire.

Thompson was struck by multiple bullets and immediately collapsed. The gunman then fled the scene, remarkably escaping on a bicycle heading uptown. The brazenness of the attack, caught on camera, initially fueled calls for the maximum penalty.
