What makes this case particularly unsettling is the fate of Burton’s accomplice. The man who pulled the trigger is no longer facing the death penalty, while Burton, who carried a gun but didn’t fire it, is poised to be executed. This disparity has ignited a fierce debate about justice and accountability in Alabama.

Burton’s physical condition has dramatically declined during his years in prison. He now relies on a wheelchair and wears a padded helmet due to frequent falls. Despite his deteriorating health, the execution date remains firm, leaving little hope for reprieve.

Burton, who was convicted for his role as an accomplice in a 1991 auto store robbery that led to the shooting death of customer Doug Battle.Gov. Ivey said a 30-hour time frame is scheduled to begin at 12 a.m. on Thursday, March 12, and will expire at 6 a.m. on March 13.Burton was sentenced to death in 1992, though it was another man, Derrick DeBruce, who shot and killed Battle during the incident.

The events leading to this situation unfolded in the summer of 1991. Burton traveled with Derrick DeBruce and others to an AutoZone store in Talladega, participating in an armed robbery. Burton carried a firearm during the heist and took money from the safe, but he left the building before the deadly confrontation.

Inside the store, DeBruce shot and killed Doug Battle during an altercation. Both men were initially sentenced to death under a state law allowing accomplices to receive the ultimate punishment when a death occurs during a serious crime. Burton was not present when the fatal shot was fired.

Over time, DeBruce’s sentence was reduced. Appeals led to the overturning of his death penalty conviction, replaced with life imprisonment without parole. Ironically, the state argued that allowing DeBruce to live while executing Burton would be “arguably unjust,” a prediction now tragically coming to pass.

The method of execution planned for Burton is relatively new and controversial. Alabama will use nitrogen gas, a process designed to cause death through oxygen deprivation. The prisoner is strapped to a gurney and a mask delivers pure nitrogen, inducing hypoxia. Alabama was the first state to utilize this method in 2024.

The impending execution has prompted a wave of reflection and protest. Former jurors from Burton’s trial and even the victim’s daughter have voiced their concerns. Tori Battle, daughter of Doug Battle, penned an essay titled ‘I lost my father to violence. Executing the wrong man won’t bring justice,’ arguing that true justice demands truth and mercy.

Battle’s perspective underscores a profound moral question: does executing someone who didn’t directly commit a murder truly serve justice, especially when the perpetrator lives? Her words echo a growing sentiment that the pursuit of retribution should not come at the cost of fundamental fairness.
