FEDS RESTRAINED: Portland Protests Just Got a HUGE Win!

A federal judge in Oregon has issued a significant ruling, sharply curtailing the authority of federal agents to deploy tear gas and other forceful crowd-control measures during protests. The restrictions center on demonstrations held outside the U.S. Immigration and Customs Enforcement building in Portland, a focal point of ongoing unrest.

The legal challenge, spearheaded by the American Civil Liberties Union of Oregon, argued that the deployment of chemical munitions was a deliberate attempt to suppress First Amendment rights. Plaintiffs presented compelling evidence, detailing instances where agents targeted peaceful protesters and journalists with sprays and projectiles.

Testimony during a three-day hearing painted a stark picture. Demonstrators, including one known for a distinctive chicken costume and an elderly couple in their eighties, recounted being directly targeted. Freelance journalists also described being caught in the crossfire, documenting the escalating tensions.

Judge Michael Simon, in a detailed written opinion, meticulously reviewed video evidence. He found it “unambiguously” showed agents spraying OC spray directly into the faces of nonviolent protesters and firing tear gas and pepper-ball rounds into crowds. This conduct, he asserted, was demonstrably chilling to protected speech.

The Department of Homeland Security previously defended its agents’ actions, claiming they used only the minimum force necessary for self-defense and to protect federal property. However, the judge’s ruling directly contradicts this assertion, highlighting a pattern of excessive force.

A separate case, brought by residents of an affordable housing complex near the ICE building, also resulted in restrictions on the agents’ use of tear gas. This underscores the widespread concern over the escalating tactics employed during the protests.

The judge’s order now prohibits agents from using chemical or projectile munitions unless faced with an imminent threat of physical harm. Furthermore, it specifically forbids targeting the head, neck, or torso, reserving such force only for situations justifying deadly force.

Indiscriminate use of pepper spray affecting bystanders is also banned. Agents are now directed to target only individuals engaged in violent unlawful conduct, actively resisting arrest, or acting in legitimate self-defense. Simple acts of passive resistance, like trespassing or refusing to disperse, are no longer considered justification for force.

Significantly, the judge granted provisional class certification, extending the protections of the injunction to all individuals who have peacefully protested or reported on demonstrations at the ICE building in recent months. This broadens the impact of the ruling considerably.

The preliminary injunction will remain in effect as the lawsuit progresses, promising a continued legal battle over the limits of federal authority during protests. The ruling arrives amidst nationwide demonstrations against federal deportation policies.

Portland’s mayor had previously demanded ICE’s departure from the city, condemning the federal officers’ tactics as a blatant trampling of constitutional rights. He described the protests as peaceful and criticized the use of aggressive crowd-control measures against law-abiding citizens.
