A legal challenge is mounting against the Trump Administration, accusing it of racially motivated decision-making in its attempt to end Temporary Protected Status (TPS) for Somali nationals living in the United States. Advocates and immigrants fear the move will force over a thousand people into the impossible choice of self-deportation or facing immigration enforcement.

The core of the lawsuit centers on a pattern of disparaging remarks made by President Trump regarding the Somali community. The challenge specifically cites instances where the President publicly labeled Somali people with derogatory terms and explicitly stated his desire to exclude them from the country.

Plaintiffs, including African Communities Together and the Partnership for the Advancement of New Americans, argue these statements reveal a clear intent to target Somali nationals based on their race and origin, violating the U.S. Constitution. The Department of Homeland Security is named as the defendant in the case.

This legal battle unfolds against a backdrop of increased scrutiny on Somali populations, particularly in states like Minnesota. Recent reports of alleged fraud involving Somali-led schemes have fueled the administration’s focus and contributed to the push to end TPS.

The administration’s initial move against Somali TPS came in November, following news of alleged fraud schemes that reportedly siphoned billions from Minnesota government assistance programs. The decision was initially announced via a post on Truth Social, framing Minnesota as a hub for illicit activity.

The official termination of TPS for Somalis was formalized in January by the outgoing Secretary of Homeland Security. Despite a change in leadership at the agency, the administration maintains its position, asserting that conditions in Somalia have improved sufficiently to no longer warrant the designation.

The administration defends its decision by stating that TPS is intended to be temporary and that allowing Somali nationals to remain in the U.S. is not in the nation’s best interest. This stance prioritizes “Americans first,” according to a DHS spokesperson.

TPS, established under the Immigration Law of 1990, provides a safe haven for individuals from countries experiencing temporary crises – war, natural disasters – preventing their safe return. The designation can be extended for 18-month periods by the attorney general.

Somalia has held TPS designation for an unusually long period, spanning 35 years since its initial granting in 1991. This extended protection reflects the persistent instability and challenges facing the nation.

However, the lawsuit argues that dangerous conditions persist in Somalia, citing ongoing terrorist activity from groups like al-Shabaab. Recent TPS extensions themselves acknowledged widespread insecurity and documented human rights abuses, including executions, violence, and the recruitment of child soldiers.

The plaintiffs point to the 2024 redesignation which explicitly noted the continued presence of armed conflict and the resulting human rights abuses against civilians. These conditions, they contend, clearly demonstrate that Somalia remains unsafe for returnees.

The Department of Homeland Security has declined to provide specific details regarding its on-the-ground assessments of the current situation in Somalia, leaving unanswered questions about the basis for its decision to terminate TPS.
