NEVADA STRIKES BACK: Kalshi's Gamble FAILS!

A legal battle between Kalshi, a prediction-market operator, and Nevada regulators is escalating, as a federal judge has refused to halt the case’s return to state court. The decision, handed down by U.S. District Judge Miranda M. Du, effectively clears the path for Nevada to pursue its claims against the company within its own judicial system.

The core of the dispute centers on whether Kalshi’s event-based trading markets constitute illegal gambling under Nevada law. State regulators, through the Nevada Gaming Control Board, argue they do, initiating a lawsuit that Kalshi attempted to move to federal court. That initial move was unsuccessful, with the judge previously determining federal jurisdiction was not appropriate.

Kalshi appealed that decision, simultaneously requesting an emergency stay to keep the case in federal court while the appeal process unfolded. This request was firmly denied, with Judge Du ruling that Kalshi did not meet the requirements for either an automatic or discretionary pause of the proceedings.

The judge specifically rejected Kalshi’s reliance on a procedural rule intended to briefly pause enforcement of judgments, stating that the earlier ruling was not a judgment on the merits of the case, but simply a decision about where the case should be heard. It concerned jurisdiction, not the substance of the allegations.

Further solidifying her decision, Judge Du applied a four-factor test established by the Supreme Court, weighing Kalshi’s chances of success on appeal, potential harm to the company, potential harm to others, and the public interest. She found that the most critical factors – likelihood of success and irreparable harm – both favored Nevada.

The court determined Kalshi’s appeal was unlikely to succeed because the company had not properly invoked a federal law allowing for the transfer of cases to federal court. Attempts to amend their filing to include this argument were dismissed, as the court’s jurisdiction was limited to resolving the stay request at that point.

Kalshi also argued that proceeding in state court would cause irreversible damage, a claim the judge swiftly dismissed. She stated that litigating in state court does not constitute harm, let alone irreparable harm, and that delaying the case could actually harm Nevada regulators and the public interest.

The judge highlighted previous findings suggesting Kalshi’s markets could pose risks to Nevada’s established and heavily regulated gaming industry. This concern underscored the importance of allowing the case to move forward without further delay.

This ruling arrives as Kalshi faces increasing legal challenges in multiple states. Regulators in Nevada are also seeking to remove a temporary injunction that allowed Kalshi’s markets to operate, and similar attempts to gain relief in other jurisdictions, including Ohio, have recently failed.

With the stay request denied, the federal court has ordered the case file transferred back to the First Judicial District Court in Carson City, Nevada. The legal showdown between Kalshi and Nevada regulators will now continue at the state level, promising a potentially decisive outcome for the future of prediction markets within the state.
