A fierce legal battle is unfolding as Nevada regulators push to keep a case against Polymarket moving forward, accusing the platform of operating an illegal gambling enterprise within state lines. The dispute centers on whether Polymarket’s prediction market constitutes unlicensed betting, a direct challenge to Nevada’s strict gaming laws.

Nevada’s legal team argues this is fundamentally a state enforcement action, stemming from Polymarket’s alleged failure to secure the necessary licenses before offering sports and event-based betting to Nevada residents. They are actively opposing Polymarket’s attempt to halt the proceedings while it challenges the proper jurisdiction for the case.

The conflict ignited in January when Nevada regulators initially moved to shut down Polymarket’s offerings, citing violations of state gambling law. A state judge swiftly granted a temporary restraining order, acknowledging the potential for significant harm and the lack of crucial consumer protections.

Polymarket responded by attempting to shift the case to federal court, claiming its operations are governed by federal oversight and supersede state regulations. However, a federal judge disagreed, sending the case back to Nevada’s court system – a decision Polymarket is now appealing.

Nevada contends that Polymarket is overreaching in its federal argument, asserting that federal regulation alone doesn’t automatically grant immunity from state law. The state emphasizes that the core of the complaint rests on violations of Nevada’s specific gambling statutes, not a broader federal issue.

Regulators further argue that pausing the case would be detrimental, allowing Polymarket to continue potentially exposing vulnerable individuals – particularly minors – to the risks of unregulated gambling. The state court previously expressed concern that each passing day increases the number of consumers and transactions, amplifying the potential for irreparable harm.

The state’s filing highlights the urgency of the situation, emphasizing that the harm caused by unlicensed gambling cannot be easily reversed. They are imploring the Ninth Circuit Court of Appeals to deny Polymarket’s request for a stay and allow the enforcement case to proceed without further delay, protecting Nevada citizens and upholding the integrity of its gaming regulations.
