Former director of the National Institute of Allergy and Infectious Diseases Dr. Anthony Fauci concluded Wednesday’s congressional hearing without answering any questions, invoking his Fifth Amendment right more than seventy times.
Senator Rand Paul announced that the Senate Homeland Security and Governmental Affairs Committee will vote next week on holding Fauci in contempt, raising a legal question about whether a presidential pardon provides complete immunity from such sanctions.
Paul issued a subpoena after Fauci declined to appear voluntarily, and Fauci responded by accusing the senator of an “obsession” with securing his arrest, releasing over a thousand pages of personal diary entries in an effort to embarrass the lawmaker.
Republican members argue that the presidential pardon, which covers federal offenses committed between January 1 2014 and January 20 2025, does not protect Fauci from contempt charges because any alleged misconduct would have occurred after the pardon was issued.
Senator Josh Hawley asserted that the Fifth Amendment does not apply to Fauci due to the pardon, describing the situation as contempt toward the committee and the American public.
The anticipated committee vote is expected to split along party lines, with Democrats defending Fauci and Republicans pushing the resolution forward; if approved, the measure would proceed to the full Senate, where a 60‑vote threshold and possible filibuster could determine its fate.
Democratic senators criticized the hearing as a partisan oversight effort, alleging that Republicans failed to share documents before releasing them publicly and that the investigation was designed to reach a predetermined conclusion.
One Democratic member described the hearing as the culmination of months of biased actions by the majority, accusing the committee of relitigating past issues instead of focusing on current oversight priorities.
Paul rebutted these accusations, calling the claim of document withholding “categorically false” and emphasizing that the investigation was the most transparent in history, noting the creation of a public website that remained unused by Democrats.
Another Democratic senator argued that the forum was intended to entrap Fauci, noting that Democrats were unable to pose questions after his repeated Fifth Amendment pleas.
