A legal battle is erupting in Houston, Texas, as the state’s Attorney General has filed suit against city officials over a newly adopted ordinance. The core of the dispute centers on local cooperation with federal immigration enforcement, igniting a fierce debate over state versus city authority and public safety.

The ordinance, approved by a narrow margin last week, dramatically alters Houston police procedure. Previously, officers were required to wait a minimum of 30 minutes for Immigration and Customs Enforcement (ICE) to arrive when presented with an immigration warrant. This practice is now ended, a change the Attorney General argues directly clashes with state law.

The lawsuit specifically names Mayor John Whitmire, all 16 city council members, and Police Chief J. Noe Diaz as defendants. The Attorney General contends the ordinance violates Senate Bill 4, a 2017 law designed to prevent local governments from hindering federal immigration enforcement efforts.

“I will not allow any local official to push sanctuary policies that make our communities less safe,” the Attorney General declared. He insists the state legislation explicitly prohibits the type of policy Houston has enacted, framing the city’s actions as a defiance of both the Constitution and the laws passed by the state legislature.

Mayor Whitmire responded with frustration, characterizing the lawsuit as a misallocation of resources and an unnecessary intrusion into local governance. He emphasized that the ordinance is intended to enhance, not compromise, public safety for all residents of Houston.

City Council member Alejandra Salinas has passionately called for a vigorous defense of the ordinance in court. She believes the city has a legal obligation to protect the constitutional rights of its residents and uphold the law as it was duly voted upon.

Adding another layer of pressure, the Governor has threatened to withhold over $100 million in public safety funding from Houston. This funding was contingent upon the city’s compliance with immigration enforcement agreements, and the Governor warns of significant financial consequences if the city refuses to comply.

A planned City Council meeting to address the situation was postponed after the Governor extended the deadline for a response to his funding threat. The future of the ordinance, and the relationship between the city and the state, now hangs in the balance, poised for a protracted legal and political showdown.
