The legal battle between former President Donald Trump and writer E. Jean Carroll took a significant turn Wednesday as a federal appeals court refused to reconsider its stance on the $83 million defamation judgment against Trump. This decision effectively clears the path for Trump to bring the case directly before the Supreme Court, escalating the stakes in a deeply personal and politically charged dispute.

Trump’s legal team is centering its defense on the controversial claim of presidential immunity, arguing that he cannot be held liable for statements made while in office. This assertion attempts to shield him from Carroll’s accusations, stemming from statements he made denying her allegations of sexual assault.

The origins of this legal conflict trace back to 2019, when Carroll publicly accused Trump of raping her in a Bergdorf Goodman department store dressing room in 1996. Trump vehemently denied the accusation, labeling it a “complete con job” and claiming he didn’t know Carroll, even suggesting she wasn’t “his type.”

These repeated denials and criticisms formed the basis of Carroll’s defamation lawsuit. She argued that Trump’s statements damaged her reputation and caused her emotional distress, leading to a protracted and highly publicized legal fight.

In May 2023, a jury found Trump not liable for rape, but did hold him accountable for sexual abuse and defamation, awarding Carroll $5 million in damages. This initial victory for Carroll was followed by a second trial focusing specifically on the defamation claims related to statements Trump made while president.

The second trial resulted in the staggering $83 million judgment against Trump, a sum intended to compensate Carroll for the harm caused by his continued public attacks on her character and credibility. This is the judgment now poised for potential review by the nation’s highest court.

The Supreme Court is already considering an appeal of the initial $5 million ruling. With the appeals court’s latest decision, the justices may soon be faced with deciding not one, but two cases stemming from this contentious dispute, potentially setting a precedent for presidential accountability and the limits of defamation law.

Trump continues to maintain his innocence and dismiss Carroll’s claims, framing the lawsuits as politically motivated attacks. He has consistently attacked Carroll’s credibility on social media, further fueling the animosity between the two figures.
