UMVA has learned that a Marine veteran and Virginia prosecutor, Ryan Mehaffey, is taking a bold stance against a new gun ban signed by Democratic Gov. Abigail Spanberger, declaring it "unconstitutional" and vowing not to enforce it.
The law, which bans the future sale and manufacture of "assault weapons" and limits magazine capacity to 15 rounds, has sparked intense debate and criticism from many Virginians. Mehaffey, serving as the commonwealth attorney for Spotsylvania County, is drawing a line in the sand, refusing to enforce the ban and sending a letter to the Spotsylvania Sheriff instructing him that the ban "is unconstitutional and cannot be lawfully enforced."
This move comes as Gov. Spanberger faces growing criticism and slipping poll numbers amid concerns over her progressive policy agenda. Her office released a statement defending the assault weapons ban as a "critical step toward protecting families, communities, and law enforcement officers." However, Mehaffey argues that the law "strikes at the core of the militia system that existed in Virginia" and threatens the Second Amendment rights of citizens.
According to Mehaffey, the Second Amendment is not just a personal freedom, but a safeguard for a community's ability to defend itself through a "well-regulated militia." He believes that the founders intended for citizens to have the right to own firearms, including basic infantry weapons, to protect themselves and their communities. In his view, the ban on "assault weapons" and high-capacity magazines is an unconstitutional infringement on this right.
Mehaffey is not alone in his stance. Smyth County Commonwealth's Attorney Phillip Blevins, an Air Force veteran, has also refused to enforce the bill, citing its unconstitutionality. Gun-rights groups, including the NRA, Firearms Policy Coalition, and Second Amendment Foundation, are also challenging the ban in court.
Blevins emphasized that his position is not based on politics, but on "constitutional fidelity." He took an oath to support and defend the Constitution, and he intends to uphold it, even if it means standing against the government's actions. Mehaffey shares this commitment, stating that he wants to "fulfill his office with honor and be a good servant to the people" by defending their constitutional rights.
The battle over the gun ban is heating up, with Mehaffey and Blevins standing firm against the government's attempts to restrict Second Amendment rights. As the law prepares to take effect this July, the stage is set for a showdown between those who believe in upholding the Constitution and those who seek to limit individual freedoms.
Mehaffey remains confident that he and those standing with him will ultimately prevail, as the Second Amendment is "the supreme law of the land." He hopes that his actions will inspire other government officials to remain faithful to the Constitution and discharge their duties as servants of the people.
