A stunning legal development unfolded Monday as the criminal cases against both former FBI Director James Comey and New York Attorney General Letitia James were dismissed. The unexpected rulings stem from a fundamental challenge to the authority of the prosecutor overseeing the cases, casting a shadow over the investigations.

At the heart of the matter lies the appointment of Lindsey Halligan as Interim U.S. Attorney for the Eastern District of Virginia. Judge Cameron McGowan Currie, a Clinton appointee, determined that Halligan’s initial appointment violated both federal law and the U.S. Constitution’s Appointments Clause – a critical check on executive power.

The judge’s order was unequivocal: Halligan’s actions, including the indictments of both Comey and James, were deemed unlawful. Attempts by the Attorney General to retroactively validate Halligan’s position were also rejected, effectively dismantling the legal foundation for the prosecutions.

Comey had been indicted in September on charges of false statements and obstruction of a congressional proceeding, allegations he vehemently contested, claiming “vindictive prosecution.” He directly challenged Halligan’s appointment, arguing it was legally flawed.

Letitia James faced separate charges of bank fraud and making false statements to a financial institution. She, too, filed a motion to dismiss, echoing Comey’s concerns about Halligan’s authority and requesting her case be considered alongside his.

In a last-ditch effort to salvage the prosecutions, a previous Attorney General, Pam Bondi, attempted to retroactively designate Halligan as a “special attorney,” granting her the power to continue legal proceedings. This maneuver was specifically designed to counter Comey’s challenge.

However, Judge Currie’s ruling effectively nullified Bondi’s efforts. The judge clarified that the power to appoint an interim U.S. Attorney rests with the district court itself until a permanent appointment is made by the President and confirmed by the Senate.

The dismissals were “without prejudice,” meaning the cases could theoretically be refiled with a properly appointed U.S. Attorney. However, the legal battle has exposed significant vulnerabilities in the initial prosecutions and raised serious questions about the process.

News of the dismissal was met with immediate reaction. Letitia James publicly expressed her relief and gratitude, stating she remained “fearless” and dedicated to her work for the people of New York. The outcome represents a significant victory for both James and Comey, and a setback for the Department of Justice.
