A dramatic legal battle took a surprising turn Monday as a federal judge dismissed the criminal cases against both James Comey and Letitia James. The dismissal, however, is not a final victory; it’s a temporary reprieve, filed “without prejudice,” leaving the door open for future prosecution.

The core of the judge’s decision centered on a constitutional challenge to the appointment of US Attorney Lindsey Halligan. Judge Cameron McGowan Currie, appointed by President Clinton, determined Halligan’s appointment violated the Appointments Clause, a critical component of the Constitution governing how federal officials are selected.

Further complicating matters, the judge ruled that Attorney General Pam Bondi’s subsequent attempt to retroactively validate Halligan’s actions was ultimately “ineffective.” This legal maneuver failed to correct the initial constitutional flaw, leading to the case’s dismissal.

James Comey responded swiftly and forcefully, directly accusing former President Trump of orchestrating a politically motivated attack. He alleges the Justice Department was weaponized to target perceived enemies, a claim delivered in a video statement posted online.

Comey framed the situation as a fundamental threat to American principles. He argued that regardless of political affiliation, the use of the Justice Department for personal or political vendettas is “fundamentally un-American” and undermines the rule of law.

The White House has already signaled its intent to fight the dismissal. Officials confirmed the Justice Department will immediately appeal the judge’s ruling, setting the stage for a potentially lengthy and contentious legal process.

Despite the ongoing legal uncertainty, Comey expressed defiance and unwavering confidence in his innocence. He anticipates further attempts by Trump to pursue legal action against him, but vows to remain steadfast.

“I know that Donald Trump will probably come after me again,” Comey stated, “and my attitude is going to be the same. I’m innocent, I am not afraid, and I believe in an independent federal judiciary.” The case now hinges on the outcome of the impending appeal, promising continued scrutiny and debate.
