The ordeal began in 2019 when a senior colleague, identified only as ‘KS’, became her mentor and then a romantic partner. What started as a professional relationship quickly spiraled into a troubled one, filled with concerns that Ms. Rice bravely voiced to her Watch Manager, Richard Basham.

The situation escalated dramatically in March 2020 when Ms. Rice discovered her colleague had invaded her privacy, reading her personal journal. This prompted her to end the relationship, leading to a final written warning for the senior firefighter after an investigation revealed bullying and harassment through a barrage of text messages.

Kelly Rice, a female firefighter pictured in her protective clothing with a fire truck behind her, won more than £40,000 after being left traumatised when a male colleague with whom she had a romantic relationship read her diary.

Ms. Rice felt the disciplinary action was insufficient, believing it signaled an acceptance of unacceptable behavior. Her attempts to address this perceived injustice were stonewalled, leaving her feeling unheard and unsupported. The fire service insisted she couldn’t influence the disciplining of another firefighter.

Seeking respite from the mounting stress, Ms. Rice transitioned to a temporary role at headquarters, a move that demonstrably improved her mental wellbeing. However, this period of stability was abruptly shattered when she was ordered back to active duty, despite medical advice warning of a potential relapse in her mental health.

Dr. Galey, providing occupational health advice, expressed concern that forcing Ms. Rice back into active firefighting would only “result in further issues with her mood and anxiety,” highlighting the lack of consideration for her wellbeing. The insistence on returning to a triggering environment felt like a profound injustice.

The relentless pressure led Ms. Rice to take sick leave in May 2021, citing the experience of “coercive control” and the resulting “complex post-traumatic stress disorder.” Even while on leave, with permission to pursue other work, she was subjected to a final written warning, further compounding her distress.

Disciplinary proceedings resumed in 2022 over her non-attendance at meetings and failure to comply with a return-to-work scheme. Faced with an unyielding system, Ms. Rice resigned in August 2022, but her appeals were dismissed, leaving her feeling utterly defeated.

In a powerful testimony to the tribunal, Ms. Rice detailed the profound toll the ordeal had taken on her life. She spoke of shattered confidence, a lost sense of self-worth, and strained relationships with loved ones, describing how even simple tasks had become overwhelming.

Employment Judge Paul Cadney ruled in Ms. Rice’s favor, citing the mistreatment stemming from the requirement to return to operational duties, the initiation and continuation of disciplinary action, and the dismissal of her appeals. The tribunal found the council had failed to accommodate her mental illness.

The case serves as a stark reminder of the critical need for workplaces to prioritize mental health and foster a culture of genuine support. It underscores the devastating consequences of ignoring the wellbeing of employees and the importance of reasonable adjustments for those struggling with mental health challenges.
