A fierce battle is brewing over justice in Fairfax County, Virginia, as a pro-law enforcement group prepares to demand a federal investigation into the practices of a local prosecutor. The Law Enforcement Legal Defense Fund (LELDF) intends to request the Justice Department scrutinize Commonwealth’s Attorney Steve Descano, alleging a pattern of leniency towards individuals facing criminal charges who are also in the country illegally.

This isn’t a novel legal tactic. The very law LELDF seeks to employ – a “pattern-or-practice” provision – was previously wielded by the Biden administration against police departments across the nation. Investigations in Louisville, following the Breonna Taylor tragedy, and in cities across New Jersey, Mississippi, and Tennessee, all utilized this same oversight authority to examine allegations of civil rights violations.

The core of the controversy centers on Descano’s stated policy of considering immigration consequences during prosecution. He argues this approach ensures equal protection under the law for all, regardless of status, and prevents the unnecessary fracturing of families and communities. He has publicly criticized efforts to link him to increased crime, pointing to a significantly lower murder rate in Fairfax County compared to the state average.

However, LELDF contends this policy actively violates the Constitution, creating a two-tiered system of justice that favors non-citizens over American citizens. They allege a deliberate pattern of leniency, citing internal memos from Descano’s office explicitly directing prosecutors to weigh immigration factors when making charging and plea decisions.

The case of Marvin Morales-Ortez has become a focal point. Initially charged with first-degree murder, the charges were dropped by Descano’s office, citing insufficient evidence. Shortly after his release, Morales-Ortez was allegedly involved in another shooting. This sequence of events ignited outrage, with some officials directly blaming the county’s policies for the subsequent crime.

LELDF’s formal request will be directed to Deputy Attorney General Harmeet Dhillon, urging a comprehensive investigation into whether Descano’s office is operating a discriminatory system that endangers public safety. They argue the prosecutor’s memo provides the necessary foundation for a federal inquiry, highlighting its explicit direction to prioritize immigration consequences in certain cases.

The group asserts that Descano’s approach prioritizes minimizing the “detrimental impact” of deportation on families and communities, even when the severity of the offense might otherwise warrant harsher penalties. This, they claim, creates an unacceptable disparity in how justice is applied, undermining the principle of equal protection for all citizens.

The stakes are high, and the outcome of this potential investigation could have far-reaching implications for how prosecutors balance public safety with considerations of immigration status. It represents a significant challenge to a progressive policy and a renewed focus on the rights of victims and the safety of communities.
