BALCONY PLUNGE: He's Facing Prison!

The New Year began with a tragedy in Montreal’s Mercier-Hochelaga-Maisonneuve borough, a fall from a third-storey balcony that has now escalated into a manslaughter charge. What initially appeared as an aggravated assault is now being treated as a far more serious crime, forever altering the lives of those involved.

James Theramene, 31, appeared in court via video conference, his face visible from a city jail cell. He formally denied any wrongdoing, entering a not guilty plea through his legal counsel, William McCann. The courtroom held a palpable tension as the proceedings unfolded.

A surprising shift occurred during the hearing: the Crown withdrew its initial objection to Theramene’s release. However, freedom came with conditions, including a $5,000 bail deposit provided by his father. These stipulations underscore the gravity of the accusations.

On Jan. 1, Tadjan'ah Desir, 31, fell from a third-storey balcony of a building on on Ste-Catherine St. E., near Jeanne-d’Arc Ave.  Neighbours told police they witnessed a man push the woman off the balcony during an altercation at around 8:15 a.m. that morning.

Adding another layer of complexity, the prosecutor requested the court seal Theramene’s home address, citing reasons she wished to keep confidential. Despite objections from a journalist present, the judge granted the request, highlighting the sensitive nature of the case and the need to protect potential witnesses or evidence.

A procedural concern was raised regarding the lack of advance notice given to the media about the request for a publication ban. Standard practice dictates informing news outlets to allow for legal representation during such requests, a courtesy not extended in this instance.

The victim, 31-year-old Tadjan’ah Desir, suffered devastating injuries after falling from the balcony on Ste-Catherine St. E. on January 1st. Witnesses reported seeing a man push the woman during a heated altercation, a scene that unfolded before horrified neighbours.

First responders found Desir unconscious on the sidewalk, and despite five days of intensive medical care, she succumbed to her injuries. Her death marked the first homicide recorded by Montreal police in the new year, casting a dark shadow over the city’s fresh start.

Theramene was immediately arrested at the scene, initially facing an aggravated assault charge. That charge has now been replaced with the more severe count of manslaughter, reflecting the Crown’s assessment of the evidence and the circumstances surrounding Desir’s death.

The case is set to return to court in March, promising further revelations and legal battles. The investigation continues, seeking to uncover the full truth behind this tragic event.

In the wake of this loss, Tadjan’ah Desir’s sister, Cynthia Desir, launched a fundraising campaign to help cover the costs of her sister’s funeral. The community responded with remarkable generosity, exceeding the $12,000 goal with over $11,000 raised as of Thursday.
